Please read the following carefully and in its entirety. This License Agreement describes the terms by which you may use the online services provided at GourmetGaming.com. By clicking "I Accept", you accept all terms of the agreement. Rational Brothers LLC, hereafter Owner, or Company, is the owner and operator of the web site and online service. The Owner may add, remove, or modify this license by posting a revised License and identifying the date of the update. Updates may occur at any time. Even if not prompted to accept the new terms, your continued use of the system constitutes your agreement to all such terms. If you decline this License Agreement, you may not use the online system.
Upon your acceptance, Rational Brothers LLC will grant to you a non-exclusive limited license ("License") to use the Software, and Gaming Services solely in connection with playing Games via your authorized and fully paid Account.
GourmetGaming.com is a web site and online service providing a meeting place for friendly, competitive, social game play. The service is available to all authorized client applications running on smart phones, tablets, personal computers and the like. Users must create an account with a username, and valid email address to be able to access the online system.
The account you create with GourmetGaming service is personal to you, and may not be transferred, sold or shared with other persons. The service is intended for persons 13 years old an over. If you are between the ages of 13 and 18 inclusive, you must have your parent or guardian complete the registration for you, and such parent or guardian shall be responsible for all obligations under this License, and responsible for all activities conducted through the account. The Game Service is not directed to persons under the age of thirteen. If you are under the age of thirteen, you may not create an account, and are asked to not provide any personal information to any online system, including this one, without your parent's permission and direction.
You are responsible for your login and user name. You may not allow others to use your username or login. Usernames and passwords may not be chosen such that they violate anyones copyright or trademarks, and user names may not be lewd, objectionable, or obscene.
If your account was disabled or terminated, you are not eligible to create a new account without written permission from the Company.
You agree to behave civilly while using the web site and Game Service. You agree to conduct yourself in a lawful and respectful manor. You may not use objectionable, obscene, threatening, or abusive language. Rational Brothers LLC reserves the right to disable or terminate your account at any time, if in their sole discretion your conduct is not acceptable. You also acknowledge that communications are not pre-screened, and agree to hold the Company blameless for objectionable communications from others.
Games are purchased through the medium in which you are most comfortable playing, such as mobile application stores for smart phones, or at the GourmetGaming.com web site. All game clients can play online together through the Game Service provided. You will receive the right to play the game online for as long as the Game Service is available.
You may not copy, modify, distribute, display, transmit, reproduce, publish, license, or create derivative works from any information, software, products, images, or services obtained from the Game or Game Service.
Any reproduction or distribution not in accordance with the License is prohibited by law. You may not modify, reverse engineer, disassemble, decompile, or hack the Software or communication systems in any way.
You may not use the intellectual property contained in the Software or Game Service to create or provide any other means through which others may play, as through service emulators. You may not take any action that imposes an unreasonable or disproportionately large load on the Company's infrastructure.
You grant to the Company the unrestricted and irrevocable right at no fee to use, copy, modify, publish, perform, transmit, and display any content you submit via any media, and waive any moral rights you may have in such content.
As a condition of your use of the Games and/or Game Services, you agree you will not use the Games or Game Services for any purpose that is unlawful or prohibited by these terms, conditions, and notices. You may not use the Games or Game Services in any manner that could damage, disable, overburden, or impair any Rational Brothers LLC web site or service or the network(s) connected to any Company web site or service, or interfere with any other party's use and enjoyment of any of the Company's web site or services. You may not attempt to gain unauthorized access to any Rational Brothers web site or services, other registrations, accounts, computer systems, or networks connected to any Company web site service, through hacking, password mining, or any other means. You may not cheat or steal or obtain or attempt to obtain any materials or information through any means not intentionally made available through the Company's web site or service. Any use of third party software in conjunction with the Games, Game Services, or Software is at your own risk and Rational Brothers LLC is not responsible for any damage, loss, or failure associated with such use.
This license is effective unless and until terminated by either you or Rational Brothers LLC. You may terminate this License at any time by providing the Company with written notification. The Company may terminate this license and deny you access to the Game Services and your Account at any time if you a) breach this License; b)infringe on third party intellectual property rights; c) if we are unable to verify or authenticate any information you provide to us; d) upon gameplay or while connected to the service, chat or any player activity whatsoever which is, in our sole discretion, inappropriate and/or in violation of the spirit of the Game Services as set forth above. Upon termination of the License by either you or the Company, you shall immediately discontinue use of the Game platform, the Game Service, and your Account and shall promptly destroy all copies of the installation medium and/or delete all copies of the Download. Any fees associated with your use of the Game Services are payable in advance and not refundable in whole or in part. Your obligation to pay accrued charges and fees shall survive any termination of the License. If your Account is terminated, you will immediately forfeit the right to use all your online objects.
Rational Brothers LLC does not ensure continuous, error-free, secure, or virus-free operation of the Game Service, the Game, or your Account. The Company shall not be liable for any delay or failure to perform resulting from technical difficulties. Further, the Company cannot and does not promise or ensure that you will be able to access your Account whenever you want, and there may be extended periods of time when you cannot access your Account. The Company may modify or cancel any element of the Game Service or Game in its sole discretion.
To the maximum extent permitted by applicable law, Rational Brothers LLC hereby disclaims all warranties and conditions with regard to the download, the software, the game service, the game products, the game, the account, and all other services including all warranties and conditions of merchantability, whether express, implied or statutory, fitness for a particular purpose, title and non-infringement. The Company makes no representations about the suitability of the information contained in the download, the software, the game service, the game products, the game, the account, and all other services for any purpose. The download, the software, the game service, the game products, game, the account, and all other services are provided "as is" without warranty of any kind.? Some states to not allow the disclaimer of implied warranties; as such the foregoing disclaimer may not apply to you in its entirety.
In no event shall Rational Brothers LLC be liable for any special, indirect, or consequential damages or any damages whatsoever resulting from loss of use, data, or profits, whether in an action for contract, negligence, or other tortious action, arising out of or in connection with the use or performance of the download, the software, the game service, the game products, the game, the account, and all other services, provision of or failure to provide related services, or information available from the services. The Company's liability to you or any third parties is limited to the price of the software. Some states do not allow the foregoing limitations of liability; as such they may not apply to you in their entirety. You agree to indemnify and hold the Company, subsidiaries, affiliates, officers and employees harmless from any claim, demand, or damages, including reasonable attorney's fees, asserted by any third party arising in connection with your use of your account, the game, or the game service.
This License is governed by the laws of the State of Illinois, USA. By your acceptance and use of this software and service, you irrevocably consent to the exclusive jurisdiction and venue of the courts of Illinois for all disputes arising out of or relating to this License. If any part of this License is determined to be invalid or unenforceable pursuant to applicable law including, but not limited to, the warranty, disclaimers and liability limitations set forth above, then the invalid or unenforceable provision will be deemed superseded by a valid, enforceable provision that most closely match the intent of the original provision and the remainder of the License shall continue in effect. Any rights not expressly granted herein are reserved to Rational Brothers LLC.
The Software provided and the online Services are provided with restricted rights. Use, duplication or disclosure is subject to restrictions set forth in Federal laws and Regulations. You are responsible for complying with all trade regulations and laws both foreign and domestic.
